By simply placing an order and/or scheduling service, each customer implicitly and fully complies with the present general conditions. With the goal of satisfying the customer, we may modify the following sales conditions as well as its product range. Customers will be notified of any changes via our webpage.
1. Products and Services:
When a customer places an order and/or schedules service by phone or online, the customer agrees with the placement of the order once it has been submitted. No objections regarding the quantity will be accepted after the delivery driver has made the delivery. The order can neither be exchanged nor taken back to the restaurant once it has been received. We decline all responsibility if the products are not consumed immediately or if they are delivered outside the indicated delivery time. The timeframe is only given as an estimate and subject to delays due to inclement weather or traffic delays. In case the customer is absent at the time of delivery, we may be obliged to charge the delivery fee twice for a return trip.
We carefully select the quality offered by each of its partner restaurants in terms of preparation.
We must be immediately informed of any disputes regarding the quality of the meals delivered.
2. Orders and delivery:
We can take your orders as long as the selected restaurant is open.
The orders are delivered directly to the specified addresses in the shortest possible time. We cannot be held responsible for any errors or late delivery in the event the information given by the customer is incomplete or inaccurate. We therefore recommend you check the accuracy of your contact details prior to submitting your order.
We cannot be held responsible for any late delivery or failed attempt to deliver if the delivery driver cannot access the premises.
Any additional orders requiring an extra delivery will incur supplementary delivery charges.
3. Sales Products:
The menu items and prices are subject to change. The prices listed do not include sales tax and will be applied to your total.
4. Payment Options:
There are several methods of payment:
A. Cash payment upon delivery.
For security reasons, our delivery drivers only carry a small amount of change.
B. Credit card payment through our App, Square or Website.
C. Cash App, Venmo, Apple Pay, Google Pay or PayPal.
D. AJ's E-Gift Card.
E. AJ's Easy Pay.
F. Checks are currently not accepted.
We offer you the possibility of paying your order by credit card (Mastercard, Visa, Discover, Amex, Apple Pay, Google Pay, Square). Any rejection of the credit card by the banking institution may lead to the cancellation of the order or the collection of the amount owed by the customer in cash upon delivery. For security reasons, we ask that the credit card be presented upon delivery of the meal and or a signature captured.
Once your order has been received your credit or debit card will be authorized and the total amount marked for payment. Payment is made directly to AJ Eats llc acting as agent on behalf of the Partner only.
We are authorized by our Partners to accept payment on their behalf and payment of the price of any Items or delivery charges to us will fulfil your obligation to pay the price to the Partner. In some cases, you can alternatively make your payment in cash directly to the Partner by paying the Roadie at the time of delivery. Where cash payment is possible, this will be made clear on our Application before you place your order.
Partners sometimes make special offers available through our Application. These are visible when you look at a Partner menu. These offers are at the discretion of the Partner. Unless the offer terms state a fixed or minimum period for which an offer will be available, it can be withdrawn at any time, unless you have already placed an order based on the offer and we have sent the Confirmation Notice.
Note: Gift Certificates, Gift Cards and Discount Coupons from partner-restaurants and/or merchants are not valid with us and can only be used at the restaurant or merchant directly.
5. Service Availability:
Each Partner has a prescribed delivery area. This delivery area may change at any time due to factors such as weather, or demand on our service. This is to ensure that Items reach your door at their best. Our Partners each decide their own operating hours. That means that the availability of our Service, and the range of Partners from which you can order, depends on the Partners in your area. If you try to order a delivery to a location outside the delivery area or operating hours of a Partner, or the Application is otherwise unavailable for any reason, we will notify you that ordering will not be possible.
6. Orders:
When you place an order by phone or through our Application, it needs to be accepted by us or the Partner before it is confirmed. We will send you a notification when your order has been submitted- accepted (the "Confirmation Notice"). The contract for the supply of any Item you have ordered comes into existence when we send the Confirmation Notice. You are responsible for paying for all Items ordered using your account, and for related delivery charges, and for complying with these Terms, even if you have ordered the Item for someone else. Some Partners operate a minimum order value policy. This will be displayed on our Application. All Items are subject to availability. Partners may use nuts or other allergens in the preparation of certain Items. Increasing numbers of Partners will be displaying dish by dish allergens information. Where that information is not available or if you have further questions, please contact the Partner prior to ordering if you have an allergy. AJ Eats-Delivery cannot guarantee that any of the Items sold by our Partners are free of allergens.
7. Tips
When Placing Your Order:
When you place an order and/or schedule service, you will have the option to pay a tip to your Roadie, in addition to the purchase price of the Items in your order. Any payment will be collected by AJ Eats llc using the payment method used for the original order and your Roadie will receive 100% of any payment (tip) you choose to make.
After You’ve Received Your Order:
Once you’ve received your order, you may receive a notification giving you the chance to pay a tip to your Roadie. AJ Eats-Delivery will collect payment on behalf of the Roadie, as their limited payment collection agent, and payment of the tips shall be considered a direct payment from you to the Roadie. We’ll share your first name with your Roadie when we notify them of the tip. Your Roadie will receive 100% of any payment (tip) you choose to make. As this payment is made after you receive your order, this payment is non-refundable and does not form part of your order. Depending on the payment method used for your original order, your tip may show up on your bank/credit card statement as a separate payment.
8. Our Site And Our Service Change Regularly:
We aim to update our Site and our Service regularly, and may change the content at any time. If the need arises, we may suspend access to our Site and our Service, or close them indefinitely. Any of the material on our Site or our Service may be out of date at any given time, and we are under no obligation to update such material.
9. Our Liability:
We have taken every care in the preparation of our Site and our Service. However, we will not be responsible for any errors or omissions in relation to such content or for any technical problems you may experience with our Site or our Service. If we are informed of any inaccuracies on our Site or in our Service we will attempt to correct this as soon as we reasonably can. To the extent permitted by law, we exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Site, our Service, and any website linked to our Site and any materials posted on it. This does not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

These are non-participating restaurants and AJ Eats llc is not affiliated with these restaurants in any way. We provide a delivery service only, acting as your concierge or pick-up agent. By scheduling Pick-up & Delivery from AJ Eats llc you are agreeing to our terms & conditions & authorize AJ Eats llc to collect, and deliver your order to you. We do not prepare your food or your order and we are not responsible for quality & preparation of your food.
AJ Eats-Delivery uses electric Hot Delivery Mats, Insulated Food Delivery Bags and Hard Coolers when transporting temperature-sensitive foods.
Needless to say, we do our best to ensure your food stays as close to its intended serving temperature as possible.
11. Fuel Surcharge:
This is an additional fee that AJ Eats llc. may charge on top of basic delivery fees. These charges are designed to help AJ Eats llc. cover the costs associated with fuel, especially given the constant fluctuation in fuel prices.

Credit Card or Payment App-Processing Fee Reimbursement
This is an additional fee that AJ Eats llc may charge on top of basic delivery fees. This is intended to Cover Fees Charged to AJ Eats llc by processing companies when a customer pays with a credit card, debit card or payment app.
Fees vary from $2.99 to $3.99
Any additional stop made for a customer other than the original pick up & delivery shall be considered an "Extra Stop". In order to continue to provide the level of service our customers have come to expect, AJ Eats llc may charge an Extra Stop Fee
